Terms of Service

The contract between TopAdsROI and customers using the platform.

1. Acceptance

By creating an account or using the platform, you agree to these Terms and the linked Data Processing Addendum, Privacy Policy, and Acceptable Use Policy.

2. Services

TopAdsROI provides server-side ad-measurement infrastructure deployed inside the customer's own cloud — Google Cloud, AWS, Azure, or private.

3. Customer responsibilities

  • Maintain valid cloud-provider billing and compliance posture for your own tenancy.
  • Provide accurate signal data and end-user consents.
  • Comply with the Acceptable Use Policy.

4. Fees

Fees are stated in your signed order form. Pricing is not published on this website (it is calibrated to volume, markets, and scope).

5. Term and termination

Subscription terms run as stated in your order. Either party may terminate for material uncured breach with 30 days' written notice. Customers may terminate for convenience at month-end with no further commitment beyond completed periods.

Because the platform runs inside your own cloud, termination carries zero data-export risk: every event, identity, and configuration remains in your cloud and stays queryable after termination. TopAdsROI revokes deployment-support access within 48 hours of termination; nothing of yours is moved, held, or deleted by us.

6. Liability

Liability is capped at fees paid in the preceding 12 months, except for gross negligence, willful misconduct, breach of confidentiality, IP infringement, or any cap that would be unenforceable under applicable consumer-protection law.

TopAdsROI is not liable for service interruptions or losses arising from: (a) your cloud infrastructure, including any cloud-provider service outage (Google Cloud, AWS, Azure, or private); (b) your own configuration, IAM settings, or modifications to the deployed platform; or (c) ad-platform API changes or outages (Meta, TikTok, LINE, Google Ads, LinkedIn). Uptime for the data plane is governed by your own agreements with your cloud provider.

7. Governing law

To be specified in the order form. Default: laws of New South Wales, Australia for customers headquartered in AU/NZ; laws of the State of Delaware, USA for customers headquartered in US/CA (subject to overriding state-mandatory protections such as the Quebec Civil Code where applicable); laws of Singapore for customers headquartered elsewhere in APAC.

8. Changes

Material changes require 30 days' notice. Non-material changes (clarifications, typo fixes) are versioned and dated above.
